Toolbay is a marketplace for tools that sellers publish, and we respect intellectual property. If you believe something listed here infringes your copyright, tell us and we will act on a valid notice under the Digital Millennium Copyright Act (DMCA). This page explains how.
Our policy
We respond to clear notices of alleged copyright infringement and, in appropriate cases, remove or disable access to the material and terminate the accounts of repeat infringers. Sellers warrant, in our Terms, that they hold all rights needed to sell what they list.
How to file a takedown notice
If you are the copyright owner or authorized to act for one, send a written notice to our designated agent (below) that includes all of the following, as required by 17 U.S.C. § 512(c)(3):
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material you claim is infringing and enough information for us to locate it, such as the listing URL.
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf.
An incomplete notice may delay our response. On a valid notice we will remove or disable access to the material and take reasonable steps to notify the seller.
Counter-notification
If your material was removed and you believe that was a mistake or misidentification, you may send our agent a counter-notice under 17 U.S.C. § 512(g) that includes: your signature; identification of the removed material and where it appeared; a statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification; and your name, address, and phone number, together with a statement consenting to the jurisdiction of the federal court for your district (or, if outside the US, any district in which we may be found) and to accept service from the person who filed the original notice.
If we receive a valid counter-notice, we may restore the material in 10 to 14 business days unless the original complainant notifies us that they have filed a court action.
Repeat infringers
We terminate, in appropriate circumstances, the accounts of sellers or users who are repeat infringers. We may also remove listings and revoke licenses where required to address infringement.
Misrepresentations
Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Please do not use this process for claims you do not hold in good faith.
